Consumers have a ‘cooling-off period’ of seven working days in which they can cancel the contract without penalty. The period commences on the date of receipt of the goods or, in the case of services, the day on which the consumer agreed to proceed with the contract (Consumer Protection - Distance Selling Regulations 2000)
So you are within your right to cancel your order within 7 days of receipt. That said I think they only have to refund the value without postage and you'd probably have to pay the cost of postage back to them. I reckon your best bet is to keep hold of the second copy for a while and then flog it on ebay at a modest profit. Though I can see it being a bit like the Underdogs 7" !!!!! |

The money came out of my account on the 10th, so if you take into account the weekend, that's not that long really. And given the fact they e-mailed me about my order rather than the other way round, I'm not too worried yet. It does sound like they're really disorganised though if everyone's been having problems.

I had a credit card statement this morning and my payment was taken on 5th October! I guess it's comforting knowing that nobody has yet received one meaning that we all probably will.....eventually. Hope so anyway... I went to WHS in Bristol yesterday and they had none!

WH Smith must be pleased that Bauer/Q/whoever are so lacklustre at fulfilling a simple web order... makes you wonder if it wasn't planned this way from the start....?!

depends what their contract is. A lot of bands don't have full say on releases..publishing or copyright or whatever belongs to the record company

I phoned them up yesterday after checking my bank account and not seeing anything taken off and after getting the "oh we're processing the orders now so it shouldn't take long", the woman I spoke eventually agreed to cancelled my order, so I went into Glasgow city centre this morning and got one. For anyone wondering, the Argyle Street branch of WH Smiths had plenty in stock, and the person who served me commented on how popular it'd been, so I told her about the shambles with the online ordering and she seemed to understand why.
