Eh, I still think it's a great opportunity to fuck things up for the EDL and it shouldn't be wasted.

If they had label permission why would they be settling with Morrissey? Permission of any kind doesn't seem to be an issue with this case though!

Bet it's costly to sue which would presumably be the legal action you could take for use of the song without permission? The EDL have stopped use now haven't they.
There doesn't seem to be many examples of anyone being sued for use without permission. Presumably its a costly nightmare. Eminem has had success against various car firms and Apple for using his work without permission and he's often commented that he'll never put his name or work to any product. They don't seem to listen to him but he does win his cases...or has them settled out of court. America though.

I think Help for Heroes have a moral cause for suing them....not that law and morals go together....just due to them using the murder of Lee Rigby to try and gain support and demonstrating in the wake of it etc... Help for Heroes have returned their donation/prevented them from donating and they're not doing anything to give the charity grounds to sue but the EDL are poisonous with no more respect for soldiers than they have for anyone not white, clutching a beer bottle, chewing a wasp and hauling a staffie round
